Preamble

These Terms and Conditions govern participation in the Know Your Sector Competition (“the Competition”) conducted by the South African Institute of Civil Engineering (“SAICE”).

Definitions

SAICE: Shall mean the South African Institute of Civil Engineering.

The Competition: Shall mean SAICE’s Know Your Sector Competition.

Entrant: Shall mean any individual who enters the Competition.

Winner: Shall mean the Entrant selected through the random draw conducted by SAICE in accordance with these Terms and Conditions, who has met all eligibility requirements and has been formally confirmed by SAICE as the recipient of the prize for the relevant competition period.

Civil Engineering magazine: Shall mean SAICE’s official publication titled Civil Engineering.

Affiliates: Shall mean SAICE’s partners, co-promoters, agencies, sponsors, subsidiaries, holding companies, and their respective directors, officers, employees, agents, and representatives.

Good standing: Shall mean that the Entrant’s SAICE membership fees are fully paid and the membership is active and not suspended at the time of entry and at the time the prize is awarded.

Competition period: Shall mean the quarterly period during which the quiz questions are published and entries are accepted, as specified in Civil Engineering magazine.

1. Competition Period

The Competition is conducted quarterly by SAICE. The quiz questions and entry link for each competition period will be published in Civil Engineering magazine.

2. Eligibility

2.1 To be eligible for entry into the prize draw, Entrants must satisfy all of the following conditions:

2.1.1The quiz must be completed in full by the closing date specified in the relevant issue of Civil Engineering magazine.

2.1.2 All quiz questions must be answered correctly.

2.1.3 The Entrant must be a current SAICE member in good standing at the time of entry and at the time the prize is awarded.

2.2 Employees and contractors of SAICE as well as members of any SAICE committees or panels involved in the administration of the Competition are not eligible to enter or win.

2.3 Previous Winners of the Competition will become eligible to win after a period of twelve (12) months has elapsed from the date they were last declared a Winner.

3. Draw and Winner Selection

3.1 All Entrants who meet the eligibility criteria set out in clause 2 will be entered into a random draw. Only one Winner will be selected per competition period.

3.2 In the event that no Entrant meets the eligibility criteria, SAICE reserves the right not to declare a Winner for that competition period.

3.3 The Winner will be notified by email using the contact details provided at the time of entry. SAICE accepts no responsibility for incomplete or inaccurate contact details provided by Entrants.

3.4 Should the Winner not respond to SAICE within ten (10) business days of notification, or should SAICE be unable to make contact with the Winner after reasonable attempts, SAICE reserves the right to disqualify the Winner and conduct a new draw to select an alternative Winner.

4. Prize

4.1 The prize for each competition period is ZAR 25 000.00 (twenty-five thousand rand), which will be paid via electronic funds transfer.

4.2 Prizes are non-transferable and may not be exchanged, deferred, or redeemed for cash alternatives.

4.3 Prior to payment, the Winner will be required to provide valid proof of identity and banking details acceptable to SAICE. Failure to provide such information within the timeframe specified by SAICE may result in forfeiture of the prize.

4.4 Any tax implications arising from a prize will be the responsibility of the Entrant.

5. Winner Announcement

5.1 The Winner will be announced in Civil Engineering magazine.

5.2 The Winner will be required to supply SAICE with a recent photograph and a short professional biography for publication purposes. By accepting the prize, the Winner grants SAICE the right to publish their name, photograph, and biography in Civil Engineering magazine and on SAICE’s digital, marketing, and social media platforms, without further compensation or approval.

6. Personal Information

6.1 By participating in the competition, Entrants agree to provide accurate and current information.

6.2 By entering the Competition, Entrants consent to the collection, processing, and storage of their personal information by SAICE for the purposes of administering the Competition and communicating with Entrants.

6.3 SAICE will process all personal information in accordance with the Protection of Personal Information Act, 4 of 2013 (“POPIA”). Personal data will not be shared with third parties except where required by law or necessary for the fulfilment of the prize.

7. Disqualification

7.1 SAICE reserves the right to disqualify any Entrant who is found to have provided false information, breached these Terms and Conditions, violated SAICE’s Code of Ethics, or engaged in any conduct that SAICE, in its sole discretion, deems to be dishonest, fraudulent, or in bad faith.

8. Changes to the Competition or Terms

8.1 SAICE, its Affiliates, and third-party suppliers reserve the right to amend, postpone, suspend, or cancel the competition and any prizes without notice at any time.

9. Disclaimers

9.1 By participating in the Competition, the Entrant agrees to release SAICE from any liability arising from their participation.

9.2 SAICE shall not be held liable for any loss, damage, or injury (direct, indirect, incidental, or consequential) except where such liability cannot be excluded by law.

9.3 SAICE’s decision regarding all matters relating to the Competition shall be final and binding, and no correspondence will be entered into.

10. Governing Law

10.1 These terms and conditions are governed by the laws of the Republic of South Africa.

10.2 Participation in the Competition constitutes acceptance of these Terms and Conditions.
